Pro Skills Basketball Terms of Service
1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of the websites, registration platform, parent and coach accounts, mobile experiences, and related services (collectively, the "Services") operated by Pro Skills Basketball ("PSB," "we," "our," or "us"), including the platform available at app.proskillsbasketball.com.
By creating an account, registering a player, signing in, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
These Terms incorporate by reference our Privacy Policy and our published Policies, including the Payment Policy, Refund Policy, Injury Policy, Codes of Conduct, Child Protection Policies, and Non-Discrimination Policy. Where a separately signed membership agreement conflicts with these Terms, the signed agreement controls as to its subject matter.
2. Who May Use the Services
The Services are intended for use by parents and legal guardians who are at least 18 years old. Accounts must be created and maintained by an adult.
Youth athletes do not create their own accounts. A parent or guardian registers the athlete and is responsible for all activity on the account, including all registrations, payments, and communications submitted through it.
Coaches, team managers, and staff may be granted accounts with role-specific access. Use of a staff account is subject to these Terms and any applicable employment or contractor agreement.
3. Accounts and Sign-In
You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your login credentials. Notify us immediately at admin@proskillsbasketball.com if you believe your account has been accessed without authorization.
Sign in with Google. You may choose to sign in using a Google account. If you do, Google shares a limited set of information with us (your name, email address, and profile picture) solely so we can create and authenticate your PSB account. We do not receive your Google password. We do not access your Gmail, Google Drive, Contacts, Calendar, or any other Google service. We do not sell this information or use it for advertising. You may revoke our access at any time through your Google account permissions page.
We may suspend or terminate an account that violates these Terms, that is used to abuse or harass staff or families, or where required to protect the safety of participants.
4. Registration, Tryouts, and Roster Spots
Submitting a registration or an interest form is a request, not a guarantee of placement. Team placement follows tryouts and evaluation, and roster spots are offered at PSB's discretion and subject to capacity.
Where a roster spot is offered, the offer is held open for a limited time stated in the offer. Acceptance requires completing registration, signing the applicable membership agreement, and initiating payment. An offer that is not accepted within the stated window may lapse and the spot may be offered to another athlete.
Program details (including schedules, locations, coaching assignments, and rosters) may change. We will communicate material changes through the Services.
5. Fees, Payment Plans, and Billing Authorization
Participation requires a financial commitment. By registering, you authorize PSB and its payment processor to charge the payment method you provide according to the payment schedule presented to you at checkout and included in your signed membership agreement.
The payment schedule shown to you at checkout governs your obligation. Before you complete registration, we display the dated schedule of every charge, the amount of each, and the date each will be charged. That same schedule is included in your signed agreement, in your confirmation email, and in your account.
You should understand and agree that:
- Payment is collected at registration. The registration payment covers the applicable month as disclosed in your schedule at checkout.
- Payment plans may include a processing fee. Where you pay by installment, a card processing fee may be added to each installment. The fee, if any, is disclosed in the schedule you review and sign.
- Paying in full may waive the processing fee. Where offered, the pay-in-full option is charged at the stated season price with no processing fee added.
- Installment amounts may vary between installments. Your schedule may include an installment that is larger than the others because it covers more than one month. Where this applies, the schedule identifies which installment is affected and why, before you sign.
- You owe the full season amount regardless of the plan you select, your athlete's participation level, or early withdrawal, except as stated in the Refund Policy and Injury Policy.
6. Late Payment, Refunds, and Cancellation
Late payment, refund, injury, and cancellation terms are governed by the Payment Policy, Refund Policy, and Injury Policy published at proskillsbasketball.com/policies, which are incorporated into these Terms.
In summary, and without limiting those policies: accounts are considered past due five days after a payment is due; a past-due account may result in the athlete being held out of practices and games and, on continued non-payment, removed from the roster; and PSB maintains a no-refund policy, with limited exceptions for qualifying long-term injury or illness supported by a physician's note.
7. Discounts and Scholarship Codes
PSB may issue discount codes and scholarship awards at its discretion. Scholarship awards are issued to a named athlete, are single-use, and may not be transferred, sold, or redeemed by anyone else. Promotional codes may be limited to specific programs or time periods. PSB may decline, revoke, or expire a code that is misused.
Issuance of a scholarship in one season does not entitle a family to one in any future season.
8. Uniforms and Gear
Uniforms and team gear are ordered through our third-party team store partner. When you order, that transaction is governed by the store's own terms, and its pricing, sizing, fulfillment, shipping, and return policies apply. PSB is not the seller of record for those items.
Team membership requires ordering the applicable gear package. Returning athletes may have the option to reuse a uniform from a prior season where PSB offers that option; the choice of whether to purchase a new uniform belongs to the family.
9. Communications
By providing your email address and phone number, you consent to receive communications from PSB relating to your athlete's participation, including registration confirmations, payment notices, schedule changes, and safety information. These are transactional messages and are necessary to deliver the Services.
You may separately opt in to marketing and promotional messages, and may opt out of those at any time by using the unsubscribe link in any email or by replying STOP to any text message. Opting out of marketing does not stop transactional messages about your athlete's participation and billing.
Message and data rates may apply. See our Privacy Policy for full SMS terms.
10. Acceptable Use
You agree not to:
- Use the Services to harass, threaten, or abuse coaches, staff, officials, athletes, or other families
- Attempt to access another family's account, another athlete's information, or any staff-only area
- Probe, scan, or attempt to breach the security of the Services
- Use the Services to scrape, resell, or commercially exploit PSB data
- Upload malicious code or anything unlawful
- Misrepresent your identity or your relationship to an athlete
Conduct at practices, games, and events is separately governed by the Codes of Conduct, including the three-strike policy.
11. Player Safety and Medical
All participants must carry their own medical or accident insurance. PSB does not provide primary medical coverage for injuries sustained during participation.
Basketball involves inherent physical risk. By registering an athlete, you acknowledge that risk. Medical, allergy, and emergency-contact information you provide is used to protect your athlete and is handled under our Privacy Policy.
12. Intellectual Property
The Services, the PSB name and logo, and all associated content are owned by PSB or its licensors. You may use the Services only for the purpose of participating in PSB programs. You may not copy, modify, distribute, or create derivative works from the Services without our written permission.
Photography and media. PSB may photograph or record athletes at practices, games, and events, and may use those images in promotional materials, subject to any media-release preference you have recorded with us.
13. Third-Party Services
The Services rely on third-party providers, including payment processing, communications, team store, and analytics providers. Your use of those services may be governed by their own terms. PSB is not responsible for the acts or omissions of third-party providers, though we select them with care and require that they safeguard information shared with them.
14. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, PSB disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted or error-free. We are not liable for a scheduling change, a gym closure, a cancelled event, or an outage of a third-party provider.
15. Limitation of Liability
To the fullest extent permitted by law, PSB and its officers, directors, employees, coaches, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Services.
16. Indemnification
You agree to indemnify and hold PSB harmless from claims arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.
17. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.
18. Changes to These Terms
We may update these Terms. When we make a material change, we will post the updated Terms with a new effective date and, where the change affects billing or your obligations, notify you through the Services. Continued use after the effective date constitutes acceptance.
Material changes to billing terms will not be applied retroactively to a payment schedule you have already signed.
19. Termination
You may stop using the Services at any time; note that stopping use does not by itself cancel a membership or end a payment obligation. Cancellation follows the Refund Policy and the terms of your signed agreement.
We may suspend or terminate access where a family violates these Terms or the Codes of Conduct, where an account is past due, or where necessary to protect participant safety.
